Este artigo pretende fazer uma leitura do filme Beleza Americana utilizando-se da filosofia hegeliana, mais especificamente, da assim chamada dialética do senhor e do escravo. Para realizar essa tarefa dividimos nosso texto em três momentos: 1 – analisamos alguns aspectos de como se instaura uma relação entre consciências de si na vida criando, portanto, relações de dominância e subordinação em relações intersubjetivas. A contraposição entre os dois elementos determina que, para que haja reconhecimento, uma consciência de si deve subjugar a (...) outra segundo sua vontade, ou seja, uma vontade é reconhecida enquanto a outra é reconhecedora. 2 – uma apresentação de elementos centrais do filme como pano de fundo para nossa análise. 3 – tecemos um comentário do filme baseado nos elementos conceituais apresentados no item um, demonstrando como o filme pode ser compreendido como uma tentativa do protagonista de sair da indiferenciação total, estabelecer uma luta para ser reconhecido e, finalmente, sendo reconhecido em seus desejos. The present paper was written as a contribution to ongoing methodological debates within the NCC project. We focus on the neural correlates of conscious perceptual episodes. Our claim is that the NCC notion, as applied to conscious perceptual episodes, needs to be reconceptualized. It mixes together the processing related to the perceived contents and the neural substrate of consciousness proper, i.e. mechanisms making the perceptual contents conscious. We thus propose that the perceptual NCC be divided into two constitutive subnotions. The (...) main theoretical idea that emerges as a consequence of this reconceptualization is that the neural correlate of a perceptual episode is formed in the neural interaction between content-processing and consciousness-conferring mechanisms. We present a theoretical view of the cellular foundations for network-level processes involved in producing our conscious experience. Inputs to apical synapses in layer 1 of a large subset of neocortical cells are summed at an integration zone near the top of their apical trunk. These inputs come from diverse sources and provide a context within which the transmission of information abstracted from sensory input to their basal and perisomatic synapses can be amplified when relevant. We argue that apical amplification (...) enables conscious perceptual experience and makes it more flexible, and thus more adaptive, by being sensitive to context. Apical amplification provides a possible mechanism for recurrent processing theory that avoids strong loops. It makes the broadcasting hypothesized by global neuronal workspace theories feasible while preserving the distinct contributions of the individual cells receiving the broadcast. It also provides mechanisms that contribute to the holistic aspects of integrated information theory. As apical amplification is highly dependent on cholinergic, aminergic, and other neuromodulators, it relates the specific contents of conscious experience to global mental states and to fluctuations in arousal when awake. We conclude that apical dendrites provide a cellular mechanism for the context-sensitive selective amplification that is a cardinal prerequisite of conscious perception. (shrink)

En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

Two important questions arise concerning the properties that constitute the phenomenal characters of our experiences: first, where these properties exist, and, second, whether they are tied to our consciousness of them. Such properties can either exist externally to the perceiving subject, or internally to her. This article argues that phenomenal characters, and specifically the phenomenal characters of colours, may exist independently of consciousness and that they are internal to the subject. We defend this combination of claims against a recent criticism (...) according to which the unconscious phenomenal character of colours exists externally to the subject. We defend internalism about (potentially unconscious) phenomenal character by appealing to recent neuroscientific and behavioural evidence, and by rejecting the claim that externalism about phenomenal character is dialectically in a better position than internalism. In addition, we briefly present certain difficulties for externalist views of phenomenal character. These concern cases where the perceptual relation fails, but a perceptual experience still results. These points suffice to defuse the externalist critique of our view, and support the internalist variant of the consciousness-independence claim as the most plausible account of the unconscious phenomenal character of colours. Tato kritická studie se zabývá dvěma současnými knihami o epistemickém relativismu, Boghossianovou Fear of Knowledge a Halesovou Relativism and the Foundations of Philosophy. První z těchto prací se přesvědčivě pokouší vyvrátit populární relativistické a konstruktivistické teze, zatímco ta druhá předkládá obhajobu specifické formy relativismu zaměřené na filosofické propozice.

Resumen: Este artículo presenta una visión crítica de la Teoría de las Prácticas Sociales, etiqueta con la cual se agrupan aquellas teorías que definen las prácticas como el componente fundamental del mundo social. El artículo discute y presenta de modo sintético un conjunto de trabajos teóricos recientes asociados a esta teoría. Concretamente, se describe la Teoría de las Prácticas Sociales como un intento por evitar el tradicional dualismo de la teoría social en base al concepto de práctica, la cual es (...) definida como el entrecruce de materialidades, sentido y conocimiento práctico. En este contexto, se discute críticamente la forma en que la Teoría de las Prácticas Sociales entiende las dinámicas de cambio social en relación a las trayectorias de las prácticas y sus componentes. El artículo ilustra las posibilidades y limitaciones de la Teoría de las Prácticas Sociales, presentando las aplicaciones de esta teoría en el ámbito de la sociología del medioambiente y el consumo sustentable.: This article presents a critical review of Social Practices Theory, a label that group works that consider the practice as the fundamental component of the social world. The article discusses and presents in a synthetic way a set of recent theoretical works associated to this theory. Social Practices Theory is described as an attempt to avoid the traditional dualism of social theory based on the concept of practice which, following the work of Elizabeth Shove, is defined as the intersection of materialities, meaning and practical knowledge. The article discusses how Social Practices Theory accounts for the dynamics of social change by focusing on examining the trajectories of practices and their components. It illustrates the possibilities and limitations of this theory by describing how Social Practices Theory has been used in environmental sociology and sustainable consumption. (shrink)

As there is a gap of legal regulation of covenants not to compete in Lithuania, the legal doctrine and the case-law are analyzed in this article. It is recognized in judicial practice that labour laws are not applicable for the regulation of the covenants not to compete. So, the parties, an employer and employee, are free to make agreement on non-competition. There are some suggested principles how to make parties’ agreement on non-competition. Firstly, there should be disputed an adequate compensation (...) to the restrictions that would be made for an employee. Secondly, the restriction of competing should be precisely described, taking into account other issues, such as period of non-competing, employee’s qualification and duties, termination of agreement, etc. It is also proposed to supplement the Law on Competition of the Republic of Lithuania with the rules concerning the conclusion, execution or termination of these covenants. Gregorio Klimovsky argumentó en contra de los análisis sintacticistas de la noción de lenguaje. En este trabajo se examinan sus argumentos, destacando su vínculo con las discusiones recientes sobre universalidad expresiva, y se plantean algunas réplicas atendibles. Luego se adopta un enfoque general de la cuestión que resulta incompatible con el sintacticismo estricto pero que permite una reformulación aceptable, vinculada con una idea minimalista sobre el alcance de la teoría semántica. Gregorio Klimovsky argued against syntactical analyses of the notion of (...) language. In this paper I examine his arguments, noting their links with recent discussions of universal expressibility, and raise some plausible objections. Afterwards I adopt a general approach to the issue which is incompatible with strict syntacticism but allowing an acceptable reformulation, associated with a minimalist notion of the scope of the semantic theory. In this paper I asses Davidson’s analysis of action sentences stressing its quantificational structure and its views on prepositions and adverbial modification. Three arguments inspired by Grice’s ideas are deployed against it. First, I point to weird consequences of taking prepositions as defining predicates; second, I show some obstacles for Davidson’s view on adverbs; finally, I raise some doubts about his putative analysis of “negative actions”. The article deals with the conception of backward causation, i.e. with the question whether an effect can precede its cause. It analyses some arguments for possibility of backward causation. It is especially Dummett’s theory of quasi-causation that is a moderate form of backward causation concept. The article refuses the arguments for possibility of backward causation as unconvincing of false.

The article deals with a study of a distinct criminal punishment established in the Criminal Code and the Code of Punishment Enforcement of the Republic of Lithuania—restriction of liberty, as an alternative to imprisonment. Without investigating extensively the course of development of this penalty, in the article it is sought to overview the development trends of restriction of liberty; analyse the problems of enforcing this penalty and suggest measures to eliminate them; investigate whether the legal regulation of Lithuania is in (...) line with the provisions of the main international instruments relating to non-custodial sanctions (1990 United Nations Standard Minimum Rules for Non-custodial Measures (the so-called Tokyo Rules), Recommendation R (92) 16 of the Committee of Ministers of the Council of Europe to Member States on the European rules on community sanctions and measures, Recommendation Rec (2000) 22 of the Committee of Ministers of the Council of Europe to Member States on improving the implementation of the European rules on community sanctions and measures); review the progressive legal regulation of restriction of liberty in place in individual states and provide a comparison between the national and foreign experience in relation to the penalty of restriction of liberty. In addition, the article offers guidelines for the improvement of the legal regulation and implementation of the legal institute of restriction of liberty. (shrink)

In this article there is analysed an independent criminal punishment – public works, which was determined by the Criminal Code and the Punishment Enforcement Code of the Republic of Lithuania as alternative punishment to freedom deprivation punishment. Without looking into the process of historical development, it is made an attempt to overview the tendency of public works’ spreading, to analyse the problems of public works’ realisation and how to deal with them. There is compared Lithuanian legal regulations with international documents, (...) which are related with alternative punishment as alternative to freedom deprivation punishment. There is also looked over public works’ legal regulations in foreign countries, an experience of public works implementation in Lithuania and abroad and, the most important, there had been given landmarks of public works institution improvement. The article is based upon the documents of the United Nations and the Council of Europe, legal regulations and practice of public works in foreign countries, opinion and studies of foreign scientists and the other authors, the data of statistics and questioning of the officers of correctional inspections. The forceful impact of Michel Foucault’s work in the humanities and social sciences is apparent from the sheer abundance of its uses, appropriations, and refigurations. This article calls for greater self-conscious reflexivity about the relationship between our uses of Foucault and the opportunities afforded by his work. We argue for a clearer distinction between analytics and concepts in Foucault-inspired work. In so doing we draw on key moments of methodological self-reflection in Foucault’s Collège de France lectures and elsewhere. This distinction (...) helps identify different ways that Foucault might be put to productive use today as well as what can go wrong therein, a concern we develop with reference to Giorgio Agamben’s post-Foucaultian contributions to political theory. We are eager to open up a possibility that has been infrequently explored despite Foucault’s contemporary influence—-the idea that critique in and through Foucault is empirical critique. This idea can help facilitate a gain in reflexivity in the broader landscapes of contemporary theory, inquiry, and critique. (shrink)

Contract cheating is currently one of the most serious academic integrity issues around the globe. Numerous studies have been conducted, mostly in English speaking countries. So far, no such research has been conducted in Czechia, and consequently there have been no specific data available on Czech students’ fraudulent behaviour. For this study, we created a questionnaire to obtain primary data on student usage of essay mills and their self-reported exposure to contract cheating. The questionnaire focused on students and graduates of (...) Czech universities and collected a total of 1016. Of that number, 8% of respondents admit having engaged in contract cheating. The questionnaire responses yielded useful information and insight into students’ attitudes regarding contract cheating and the extent of this phenomenon in Czechia. We now know more about their reasons for contract cheating and have insight into their thoughts regarding possible discovery. (shrink)

Abstract: Daniel Wegner’s theory of apparent mental causation is often misread. His aim was not to question the causal effectiveness of conscious mental states like intentions. Rather, he attempted to show that our subjective sense of agency is not a completely reliable indicator of the actual causality of action, and needs to be replaced by more objective means of inquiry.
